Marketplace Terms
Effective 5 November 2026 · Version 2026-11-05-ad-allowances-v1
Sauda Kar connects individuals and businesses advertising goods or services. Smartionix is the platform operator; the identified seller supplies the goods or services unless an order expressly identifies Smartionix as supplier. The service is currently a controlled pilot, not a certification of seller quality, identity or regulatory approval.
Accounts and membership
You must be 18 or older and have authority to represent the named business. Provide accurate account and contact details and do not share your password. One account can buy and sell. Creating ads requires Smartionix membership approval. Membership lasts for the approved trial, monthly or annual term, subject to administrator renewal. Restrictions may be applied for confirmed abuse, unpaid expired orders, misleading ads or policy violations; reasons and review options are available through support. Existing payment, delivery and dispute duties continue during restrictions.
Ads, orders and delivery
Only new goods may be advertised. Do not list illegal, counterfeit, unsafe or restricted products/services. Advertisers are responsible for truthful specifications, stock, price, tax treatment and supply authorisation. A posted price must include the stated shipping and applicable supply charges. Partial fulfilment is permitted only when the ad allows it. Confirm the exact model, quantity, delivery arrangement and deadline before accepting. Do not treat an alternative listing as the same specification.
Marketplace membership
Default active-ad allowances are separate for buying and selling: Individual free trial, 1 on each side; Business free trial, 3 on each side; paid Individual monthly or annual membership, 5 on each side; paid Business monthly or annual membership, 10 on each side. Pending and paused ads count toward the allowance. Smartionix may set account-specific limits. Existing ads and orders are retained when a limit changes.
A free trial is available once per email address or mobile number, for 30 days from Smartionix administrator approval. No membership payment is required for the trial; normal order charges and seller fees still apply. Trial membership pauses after 30 days, with no automatic charge or paid conversion. Continued membership requires separate paid renewal and bank verification. Paid monthly membership lasts 30 days beginning when Smartionix verifies the membership payment and approves activation. An approved annual membership lasts one year. When the recorded term expires, new marketplace trading and public ads pause; existing records, order tracking and support remain accessible. An administrator may renew for 30 days, 11 calendar months or one year after checking the renewal payment. An early renewal extends the current expiry; an expired membership restarts from the renewal date. New Individual paid membership costs ₹249 monthly or ₹1,999 annually, plus 18% GST (₹293.82 or ₹2,358.82 in total). New Business paid membership costs ₹499 monthly or ₹3,599 annually, plus 18% GST (₹588.82 or ₹4,246.82 in total). The chosen plan, GST and total due are shown during registration and in the Smartionix bank-transfer instructions. Registration submits a pending application. For paid plans, bank verification and administrator approval are required; for the free trial, administrator approval is required without payment. Until the applicable approval, only membership details and approval status are available; customer sign-in, ads and orders are unavailable. After approval, sign in to use the activated account. Do not send a second payment merely because approval is pending.
Price and Smartionix fee
The buyer pays the quoted order amount. Under the current marketplace fee policy, the seller’s settlement deducts a 3% Finder’s Fee plus 18% GST on that fee. The seller sees this deduction before accepting or publishing an ad. Other statutory tax or withholding obligations depend on the supply and applicable law and require reviewed accounting treatment. A tax invoice must use the correct supplier, place of supply and product/service tax details.
Payment reports and settlement
Payment Made is a report by the buyer, not proof of receipt. A transfer must be matched to the bank account, full amount, order number and reference by Smartionix. The buyer then confirms delivery received, delivery checked and release authorisation; an administrator separately records the completed seller transfer. A display status is not a bank guarantee. No payment-provider checkout or automated bank payout is currently connected. A protected escrow arrangement must be independently established and approved before this pilot is opened for unrestricted real-money trading. Do not transfer money for a new transaction unless Smartionix confirms the approved payment arrangement.
Cancellations, disputes and refunds
An unpaid order normally expires one hour after acceptance and restores eligible ad inventory. A timely payment report remains pending while receipt is checked. Rejected reports retain the original deadline. Do not cancel or repeat orders to reserve stock without paying. Raise a dispute from the order promptly when delivery, quality or payment is in question and preserve evidence. An open dispute blocks settlement. Refunds require an investigated decision and a recorded bank transfer; they are not completed merely by raising a dispute. Contact info@smartionix.com for support.
Invoices
The seller is responsible for its sales invoice to the buyer. Smartionix may prepare it only with supplier authorisation and reviewed billing/tax details. Smartionix’s service-fee invoice is addressed to the seller. Issued invoices can be downloaded from completed orders; incomplete records show a pending state rather than a fabricated GST invoice. Downloaded documents can be printed or saved as PDF. Email delivery requires a separately configured service.
Own-account payments only
No third-party payments are accepted. An individual customer must pay from a bank account held in their own registered full name. A business customer must pay from a bank account held in its registered enterprise name. Payments from another person, relative, agent or another business are not permitted, even if made on your behalf. Smartionix may keep an unmatched payment unverified while it investigates ownership and the appropriate return or resolution; payment reporting is not confirmation of receipt. Suspected fraud, identity misuse or unlawful transfers may be reported to the bank, police, cybercrime authorities or another competent authority. A policy breach does not itself establish criminal guilt. Where legally recoverable, Smartionix may seek recovery or an authorised deduction of documented, reasonable legal expenses actually incurred, capped at 30% of the affected order amount, only after written notice, supporting details and a reasonable opportunity to respond. This is not an automatic penalty or forfeiture; recovery remains subject to applicable law and any competent authority or court decision. Your statutory rights remain unaffected.
Payment instructions require a separate, unticked acknowledgement for each order. The recorded policy version, text, registered payer name/type and acceptance time are retained as evidence. Bank receipt and payer-name matching are checked by Smartionix; acceptance alone is not bank verification.
Smartionix Trade Assurance and buyer protection
For new orders placed under this policy, buyers may raise an on-platform dispute within 21 days of placing the order. Keep payment references, order chat, invoices and delivery or service-completion evidence. A dispute raised in time remains under review after this window ends and blocks seller settlement until resolved.
Seller settlement is held until 30 days after the order is placed. Day 30 is the earliest settlement eligibility date, not an automatic payment or guaranteed bank-credit date. Release also requires verified receipt of payment, completed delivery or service, the buyer’s delivery and inspection confirmations and release authorisation, and no unresolved dispute or applicable legal hold. An authorised Smartionix administrator may approve and record an exceptional early settlement after all payment, delivery, inspection and buyer release checks pass, with the reason and actual bank transfer reference recorded. This exception does not shorten the buyer’s original 21-day dispute window or remove statutory remedies. An early-paid dispute may require recovery or a separate refund review because funds have already been sent. Existing orders retain their recorded terms.
Smartionix’s authority to decide platform disputes
Buyer and seller authorise Smartionix to examine the order, payment records, messages and evidence; seek clarification; and make a reasoned decision on the platform dispute under these Marketplace Terms. Smartionix may maintain a settlement hold and decide whether an amount should be released or referred for refund or further review, subject to applicable law and authorised payment arrangements. Both parties will be given a reasonable opportunity to provide evidence and will be informed of the decision and reasons. A review may be requested through info@smartionix.com.
Legal counsel and jurisdiction
Smartionix may engage independent legal counsel when necessary to assess a dispute or protect lawful interests. Any legal charges payable by a customer require a separately disclosed and agreed basis or a lawful order; this clause does not automatically impose legal costs. Subject to mandatory law, proceedings concerning these terms are subject to the jurisdiction of the competent courts at Jammu, Jammu and Kashmir.
The 21-day platform window, Smartionix’s platform decision and the Jammu jurisdiction clause do not exclude statutory consumer remedies, a competent consumer commission, regulatory complaints, or any right that cannot lawfully be excluded. Trade Assurance is a contractual platform process, not insurance, a bank guarantee, or a representation of regulatory authorisation.
Support, fair use and rights
Keep order communications on the platform. Do not impersonate staff, solicit third-party transfers, post abusive content, exploit the service or disclose another member’s private information. Automated restrictions based on recorded expiry history can be reviewed by an administrator. These terms do not exclude mandatory consumer rights or liability that cannot lawfully be excluded. Business disputes, cancellation rights and remedies must be reviewed on their facts rather than assumed from a status label.
